Giyani- A Scuffle charactised by war of words have ensued between Hip Hop artist, Refiloe Phoolo, well-known as Cassper Nyovest and Xitsonga popular musician and a living testimony, Benny Baloyi, well-known as President Mayengani over the word “FillUp” which Cassper sued Mayengani and Howard Mashava for using what he (Cassper) claims it’s his trademark.
It angered Xitsonga speaking community and Mayengani’s fans who took their frustrations to twitter, arguing about the legal rights and basis of owning an English word, “FillUp” – with some of the fans strongly condemning Cassper Nyovest for claiming sole ownership of an English word, “FillUp” without a matric certificate.
Cassper has been labelled as a broke man and jealous, who fails to appreciate other’s achievements.
Giyani View understands that Cassper should have interdicted the #FillUpGiyaniStadium festival before it took place last Saturday and not waiting to see the thousands of Benny Mayengani’s fans filling up the 20 000 seater Giyani Stadium.
Some of Mayengani’s fans argue that if Cassper and his legal team are confident enough for owning the “FillUp” trademark, then they should start by suing brands such as Clover, Standard bank amongst others for the use of the purported trademark on their products.
Mayengani, during his interview on SABC 2, Ngula ya vutivi current affairs program on Thursday night, told the show, anchor Sydney Baloyi that Cassper Nyovest and the guys who helped him to trademark the word “FillUp” should explain to him (Mayengani), if Manchester City football team had to say, it’s our trademark and it’s against the law to use the word “City” meaning there will be no Polokwane City and Cape town City football Clubs.
“When you use a word that has been used by somebody before, do you have to ask permission? Like Zion Christian Church, and someone wants to start a new church by the name of Apostle Nazarene Church, does he have to ask for permission to use the Word church? Remember Cassper doesn’t own the Word “Fill up” says Mayengani.
As a parting shot, Benny remarked that celebrities must also invest in education and urged the ‘Kuzobalit’ hit maker to consider going back to school and equip himself with the education to have something to fall back on, since he (Mayengani) is enrolled and studying towards a degree with the University of Johannesburg.
Mayengani presented a solemn but confident persona throughout and did not somehow look deterred by sceptics, and looked forward to his next stop, which is to “#FillUp” Peter Mokoba stadium.
